Supreme Court Dismisses The Probe Into Judge Loya Death

The Supreme Court has rejected the petitions for an independent probe in Jude Loya death case. A bench headed by CJI Dipak Misra said that the petitions demanding an independent probe were in criminal contempt since it contradicted with the statements of the four judges accompanying Judge Loya at the time of his death. The court also called the petitions “scandalous” and a “frontal attack on the judiciary”.

Controversy Of Judge Loya Death

Judge Loya died in December 2014 while he was trying the Sohrabuddin Shaikh fake encounter case. BJP Chief Amit Shah was an accused in this case and got a clean chit by the next judge.

The controversy began when The Caravan magazine with their investigative reporting came up with claims that Judge Loya was actually murdered. Soon after that 4 senior Supreme Court judges held an unprecedented press conference. The apex court maintained that Judge Loya died a natural death due to Cardiac Arrest; there was no reason to doubt the four judges. It also said that the plea to independently investigate Judge Loya death was an attempt “to malign the judiciary”.

It is clear that this decision has disappointed thousands of people across India. The question that arises is since there were so many doubts, why was the probe rejected? If there are doubts, investigation to dig deeper is not a bad option at all.
